Dear Mr. Saltzman:

This is in further response to Mr. Bingham's letter of March 17, 1978, to advise you that the City has recently discovered that on February 27, 1978, the Federal Energy Regulatory Commissic,a issued a deficiency letter with respect to the wheeling schedule filed by CEI in FERC Docket No.

ER78-194. A copy of the deficiency letter is enclosed. City would note that the FERC deficiency letter states that . .o filing date will be assigned to the wheeling schedule until the deficiencies have been corrected. To the best of City's knowledge and belief CEI has not acted to correct the defi-ciencies. In his letter of March 17, 1978, Mr. Bingham fails to address the matter of the deficiency letter.

The City now finds itself back at square one in attempting to obtain a wheeling schedule pursuant to the Davis-Besse and Perry license conditions. 'CEI's purported compli-ance with the license conditions has been cosmetic only. Once again City urges the Commission to act to enforce its license conditions.
