Dear Mr. Fouka:

Enclosed is the stipulation covering the contentions proposed by CFUR for admission as issues in controversy in this proceeding. The stipulation has been rigned by counsel for the Applicants and Staff and includes as an attach-ment 4 statement of CFUR's proposed contentions.

( The stipulation and attactament differ in some respects from the draft statement of contentions and draft stipulation forwarded to you in August and October 1979, respectively. The draft statement of con %entions and draft stipulation reflected the positions taken by the parties at the July meeting of the parties and in the parties' telephone conferences of August 31, 1979. As you recognise, these positions were not final. As a result of further negotiations between the parties subsequeet to the meeting of the partiet % July 1979 and telephone conference of August 31, 1979, there has been a chan, 3f position with respect to several contentions. In partie=1mr, we note that at ths.

partiesdeferredconsiderationofcontentions3.5.and3.3.yulymeeting,the Bowever, the parties have now agreed that deferr&1 is no looser necessary and have taken positions with respect to these sententions. Also acts a change in position regarding costantions 4.A. and 4.3. The stipnistion and attachment also now reflect the position of the parties with respect to the coatsetion proposed by CFUR fa its " Motion To Add Contention," dated October 31, 1979. This contention is designated as aumber 8. In addition, although the Applicants and Staff orally agreed to eone language changes in contention 3. A. which were suggested by CFUR in a telephone conversation, the Applicants and Staff have stipulated only to the language agreed to by the parties in our July meeting. Based so our records, these are the only shanges of substance in the stipulation and statement of contentions.

Enclosed is the stipulation covering the contentions proposed by CASE for l admission as issues in controversy in this proceeding. The stipulation has been signed by counsel for the Applicants and Staff and includes as an attach-ment a statement of CASE's proposed contentions.

( The stipulation and attachment differ in some respects from the draft statement of contentions and draft stipulation forwarded to you in August and October 1979, respectively. The draft statement of contentions and draft stipuistion reflected the positions taken by the parties at the July meeting of the parties

On Jcnuary 25, 1980, the NRC Staff filed a " Status Report on Proposed Stipula-tions and Request to Schedule Prehearing Conference." This report responded to the request of the Atomic Safety and Licensing Board (the Licensing Board) for cn cppraical of the status of negotiations among the parties to this pro-ceeding concerning the contentions of the respective Intervenors. The report reficcted the Staff's. belief, on that date, that the stipulations on contentions l which by the had been executed by the Applicants and the Staff would shortly be executed Intervenors.

Accordingly, the Staff 1) suggested that the Licensing Board schedule a prehearing conference on March 20, 1980, to hear oral argument .

on cententions and 2) proposed that the parties file statements of position on contentions on February 29, 1980.

Since the filing of the Staff's status report, the stipulations have not been executed by the Intervenors. The staff continues to be hopeful that it will  ;

be possible to reach a stipulation on contentions. However, since the parties have not yet reached such a stipulation, the Staff believes that it would be prcrature to file statements of position on contentions on February 29, 1980, espccielly since the -Licensing Board is not considering having a prehearing confercnce until April 30, 1980. The Staff therefore does not intend to file a state:,ent of position on contentions on February 29, 1980. In the event that the parties reach a stipulation on contentions, it is the Staff's inten- ,

In your request for information and documents dated August 25, 1979 you 3 requested several reports which, as our response stated, had not yet been issued. In particular, you requested reports related to the NRC staff s determination on whether the March 28, 1979, accident at Three Mile Island .-

( (TMI)-2 constitutes an " extraordinary nuclear occurrence" (ENO), as defined by the Corrission's regulations,10 CFR Part 140, BS 140.84 and 140.85. You also requested reports of the NRC Special Inquiry Croup investigating the TMI-2 accident. These reports have recently been issued. A Federal Register notice of January 4, 1980, (45 Fed. R_ej. 1180) announced that the panel making

i the determination on whether TMI-2 constitutes an "EN0" has completed its investigation, evaluation and anlaysis. The findings of the panel are con-tained in NUREG-0637, " Report to the Nuclear Regulatory Commission from the Staff Panel on the Commission's Determination of an Extraordinary Nuclear Occurrence (ENO)." Copies of the Federal Register notice and NUREG-0637 are /

enclosed. On January 24, 1980, the NRC Special Inquiry Croup issued "A Report  :
