Dear Ms. Bauman:

This is in response to your letter dated November 6,1987, in which you appealed Mr. Donnie H. Grimsley's response dated October 27, 1987.

Mr. Grimsley's response denied eight documents subject to your Freedom of Information Act (FOIA) request for documents concerning an August 25, 1987 letter from Mr. Keppler to Mr. Counsil regarding the Comanche Peak Steam Electric Station.

A portion of document four listed on the enclosed appendix was made publicly available in my letter dated November 3,1987, responding to your separate appeal F01A-87-A-77 and is enclosed. The remaining portions of document four and documents one through three and five through eight listed on the enclosed appendix will continue to be withheld from public disclosure pursuant to Exemption (5) of the FOIA (5 U.S.C. 552(b)(5))

and 10 CFR 9.5(a)(5) of the Comission's regulations.

Documents one, two, three, five, six, and eight, and the remaining portions of document four contain the advice, opinions, and recommendations of the staff. Exemption (5) shields from mandatory disclosure information generated in the deliberative process that precedes most decisions of government agencies, i

Document seven is a draft which is clearly predecisional because it was l prepared prior to and in the course of reaching a final agency decision. '

Exemption (5) was intended to permit the agency's withholding of such documents to preserve the free and candid internal dialogue necessary for the careful formulation of agency decisions.

This is a final agency action. As set forth in the F0IA (5 U.S.C.
