Dear Ms. Carde:

This letter is to set forth the details of how the Staff will make documents available to the parties once the Staff issues a Supplemental Safety Evalua-tion on a given Project Status Report (PSR).

In light of your statement to the Board concerning what I considered to be a preliminary agreement, I think it is necessary to set the Staff's intentions down in writing to avoid any future misunderstanding among the parties.

Upon the issuance of a Supplemental Safety Evaluation concerning one or y

more of the PSRs or the collective significance report, the Staff will make i

available those documents relied upon in the preparation of the SSER which are in the Staff's custody and control, which are not privileged pursuant to the Commission's discovery rules and which are not otherwise exempt from mandatory public disclosure pursuant to an exemption of the Freedom of in-l formation Act.

Due to the uncertainty as to the number of documents which will be involved, the Staff did not intend to commit to serve all documents on every party to the proceeding.

Rather, the Staff will make the docu-I ments available for inspection and copying in a place convenient for all par-ties.

We believe that such a place would be the local public document room in Arlington, Texas.

In addition, copies of the documents will also be made available in the Commission's Pub!!c Document Room in Washington, D.C.

At the time the documents are made available, a list of the documents with-held and the applicable exemption being asserted as the basis for the with-871207002e 871202 PDR ADDCK 05000445 G

This procedure should obviate the necessity for any party formally to file either a request for the production of docu-ments or a Freedom of Information Act request.
