Your March 13, 1989 letter to Dr. Murley, as supplemented by ycur March 17, 1989

letter to me, submitted a formal request for NRC action arising from a dispute between CASE and Texas Utilities Electric Company concerning the reactor coolant system cold hydrostatic test, as conducted and recorded in 1982 at Comanche Peak Steam Electric Station, Unit 1.

The purpose of this letter is to acknowledge your request, filed in accordance with paragraph B.3 of the Joint Stipulation dated June 30, 1988, and to inform you of our plans for resolution.

In accordance with paragraph B.4 of the Joint Stipulation, we anticipate that TU Electric will file a response within 21 days following your documented request for action, which in this case is deemed to be the filing of the QTC Report, " Evaluation of the Texas Utilities Comanche Peak Steam Electric Station Reactor Coolant System Primary Cold Hydrostatic Test." We have been informed that CASE and TU Electric have agreed that TU Electric has until April 19, 1989 to file their response. To assure that the staff has a clear understanding of all the information submitted by both CASE and TV Electric, the staff intends to conduct a transcribed public meeting in Dallas, Texas, within about a week of TU Electric's response. We would anticipate that our conclusion regarding the dispute and any necessary action would be issued by me two or three weeks after the public meeting.

The staff notes that CASE's request for NRC action includes the provision that the cold hydrostatic test be conducted prior to the site Hot Functional Test.

Considering the timing involved in the Joint Stipulation process for dispute resolution, this aspect of CASE's requested NRC action conflicts with TV Electric's current schedule for hot functional testing. The staff considers that the cold hydrostatic test, if it needs to be performed again, could be conducted after hot functional testing. Therefore, the staff has determined that the schedule for hot functional testing should not be impacted by the resolution of this despute.
