Manual action outside the control room to achieve ccid shutdown, Midland Plant units 1 and 2.

Dear Mr. Tedesco:

We agree with your letter concerning the open item in regard to the Degay heat removal system design. We agree with you because this is a matter of public health and safety and we are happy to see that the Nuclear Regulatory Commission is finally performing the work it is supposed to do, that is, to regulate.

Evidently, from your letter to Mr. Cook, the open item is a serious problem, and in view of the fact that the room is six floors below would indicate the concern of NRC in this matter. Thp, position that you have, that the design is not in conformance with V.D.C. 19 and is therefore unacceptable is in agreement with our in'Eerpretation of NRC directives and especially the fact that it concerns the public health and safety.

Furthermore, we do not understand and cannot comprehend why the NRC would tend to produce documents that as an example, " Nuclear Regulatory Commission Proposed Findings of Fact and Conclusions of Law," it states that, in the order that the plant can continue its apparently past practices.

We await a copy of the letter that Mr. Cook, Vice President Consumers Power Company will send you in answer to your letter described above.
