Dear Ms. Bauman:

This letter responds to your april 27, 1987 appeal of the denial of documents in the Nuclear Regulatory Commission's April 13, 1987 response to F01A-85-213.

In response to your appeal, the documents were re-reviewec., Based on that review, portions of Document 5, Appendix D, are now teing released, as listed in Appendix F. They are being placed in the NRC Public Document Room (PDR) located at 1717 H Street, N.W., Washington, DC.

With respect to the balance of the documents, I affirm the Agency's initial action. The withheld documents consist of names and other identifying information provided by a former employee of the Midland Nuclear Power Plant. To disclose this information could reasonably be expected to constitute a clearly unwarranted invasion of personal privacy. This information is being withheld pursuant to Exemptions (6)and(7)(c)oftheFreedomofInformationAct,5U.S.C.

s 552(b)(b) and (7)(C) and 10 C.F.R. 6 9.5(a)(b) and (7)(iii) of the Commission's regulations. See Department of the Air Force v. Rose, 425 U.S. 352, 372-73 (1976)T3 tern v. Federal Bureau of Investigation, 737 F.2d 84, 91 (D.C. Cir.1984); Lesar v. United States Department of Justice, 636 F.2d 472, 486 (D.C. Cir.1980).

This letter represents final Agency action on your April 27, 1987 F0IA appeal. Judicial review of the denial of documents is available in Federal District Court in the district in which you reside or have your principal places of business, or in the District of Columbia.
