Dear Mr. .Northrop and Ms. Sigler:

This is in response to a Petition pursuant to 10 CFR 62.206 dated October 24, 1986 wherein the Attorney General on behalf of the State of Ohio sought that the Nuclear Regulatory Commission institute proceedings to suspend the oper-ating license of the Davis-Besse Nuclear Power Station of the Toledo Edison Company in light of alleged deficiencies in the area of offsite emergency planning. The Petition further sought that the Commission keep the Davis-Besse facility shut down pending resolution of the alleged deficiencies.

The Petition noted that the Governor of the State of Ohio had withdrawn his support for the evacuation plans for the Davis-Besse facility and had further created tbn Ohio Emergency Evacuation Review Team (EERT) to conduct an evalu-ation of the evacuation plans currently in place. The Petition alleges that the EERT has found serious deficiencies in the plan. The Petition further alleges that the Federal Emergency Management Agency (FEMA) has not issued any formal statement concerning the adequacy of eraergency planning for the Davis-Besse facility and that, consequently, the NRC has not and cannot make required findings as to adequacy of offsite emergency preparedness for that facility.

For the reasons set forth in the enclosed " Director's Decision Pursuant to 10 CFR 2.205,", DD-86-17, the Petition has been denied. A copy of the enclosed Director's Decision will be referred to the Secretary for the Commission's review in accordance with 10 CFR 2.206(c).
