Dear Ms. Gebauer:
We have been requested by Senator John Glenn to respond to your April 30, 1987, letter to him expressing concerns regarding the Decision reached on the proposal to dispose of contaminated sludges on the Davis-Besse site.
In your letter, you urge that Congressional hearings be held regarding this action.
The basis for your request is that the Decision did not adequately consider possible environmental damages from tne proposed plan.
At an informal hearing held in Sandusky, Ohio, on August 5-7, 1986, testimony was provided by all participating parties regarding the issues concerning the disposal of water treatment sludge and demineralized resins by land ial at the Davis-Besse site.
The Decision on the Disposal of Waste a avis R ;(April 15, 1987),
concluded that there is negligible environmental hazard or risk to public health and safety.
A copy of the Decision is enclosed.
You will find that concerns similar to those of the League of Women Voters, as expressed in your letter, were aired in the hearing and addressed in the Decision.
With regard to potential for disposal of this material at a future site set up by Midwest Interstate Low Level Radioactive Waste Compact, it should be noted that the Compact only established the framework within which the member states will work.
It did not identify a host state or disposal site.
The State of Michigan has recently been designated as the host state, but the State has not acted on this decision.
The Waste Policy Act identified a set of milestones leading to the development of new facilities by 1993.
Even though a site may be available in the Compact region by that date, the very low level of potential impact upon health, safety, and the environment which could result from burial on the Davis-Besse site does not support a decision to dispose of the Davis-Besse sludges at the Compact site at this time.
Before Toledo Edison Company can proceed with the proposed disposal of the waste, additional approvals are required.
Specifically, it must be approved by the State of Ohio Environmental Protection Agency, and a permit must be issued by that agency.
This will provide additional opportunity to pursue your concerns through public hearings conducted at the state level.
