Dear Comander Covill:

ggg0 gh g On April 9,1986 a Resolution by the Greater Cleveland Boating Association adopted March 2,1986 and signed by you, the Vice Comander, and the Secretary was forwarded to me. In this resolution you recited your reasons for opposition "to bury radioactive sludge at the Davis-Besse Nuclear Power Station" and by the resolution requested that the NRC review its decision to pennit the burial.

By my Order of May 29, 1986, your resolution was acknowledged and placed in the Appendix for inclusion in the Limited Appearance Section of the Docket No. 50-346-ML.

On June 3, 1986 I received a letter dated May 30, 1986 signed by Robert W. Stickle, Chairman, Vice Commander, Greater Cleveland Boating Association, stating he was " displeased and disturbed as to the attorney's action not permitting a board of members of theirs . . . to be intervenors pertaining to this case." The April 9, 1986 resolution did not contain a petition to intervene filed by the organization in accordance with my Memorandum and Order of March 10, 1986. In that Order, I had set out How to Participate and set April 14, 1986 as the due date for those who wished to become a party to file the inforriation specified in the Order.

In the letter of May 30, 1986, Vice Commander Stickle has requested to be permitted to become an intervenor in this case. However, the date for filing for intervenor status expired on April 14, 1986. If Vice Comander Stickle wishes to make a limited appearance statement on matters before me on Davis-Besse, he may do so at one of the sessions provided for the public. At this time the hearing schedule has been postponed because of the strike at the Davis

  • esse Nuclear Power Station. Public notification of the new dat for these hearings will be established as soon as the strike is concluded. To assist persons, including Vice Comander Stickle, who may wish to make limited appearance statements I have enclosed a copy of my Memorandum and Order of May 29, 1986 in which Matters Within the Scope of Proceeding to be l
