Gentlemen:

On November 15, 1979 and again on November 28, 1979 Westinghouse Electric Corporation submitted letters to the NRC Office of Inspection and Enforce-ment and Division of Operating Reactors. The letters concerned a report-able 10CFR50.59 for operating plants and a reportable 10CFR50.55e for plants under construction.

Georgia Power Company has evaluated the rod drop analysis and has concluded that this constitutes a reportable deficiency. A 10CFR21 evaluation has also been conducted and no substantial safety hazard exists.

In letter NS-TMA-2167 Westinghouse advised that a review is being made of analytic and hardware solutions. Recommendations are to be made as part of a topical. report to be submitted to the NRC in mid-1980. Georgia Power Company will review the topical report and take appropriate corrective action for the Vogtle Nuclear Plant-Units 1 and 2.
