OPERATING COMPANY FOR THE FARLEY, HATCH AND V0GTLE PLANTS l On March 18, 1988, the NRC staff met with representatives of Southern-Campany .

Services (SCS), Georgia Power Company (GPC) and Alabama Power Company (APC) in '

Rockville, Maryland to discuss the inferination that would be required in a submittal-for amendments to the licenses and construction pemit held by APC and GPC for the Farley, Hatch and Vogtle Nuclear Plants. Attendees are listed i in Enclosure 1. The viewgraphs used by the SCS representative in his presentation are in Enclosure 2.

Mr. L. Long of SCS made the presentation. He emphasized that the companies were still evaluating the idea and concept of an operating company. His presentation was to describe generally what the licensees propose to include in their applications. He covered previous actions' that the agencv has taken -

s regarding changes in plant operators. ThechangesinTechnical_ Specifications ,

were 61so discussed, including the deletion'of the organization. charts from the wecifications as was done for the Shearon Harris Station. The staff advised him that we anticipate the issuance of the generic letter on this issue-in the near future.

There was some discussion regarding the need to file the OL application .

amendment and the FSAR amendment concurrent with the CP amendment for Vogtle Unit 2. The licensees did not believe that the amendments needed to be sub- ,

mitted concurrently and, in fact, should be done sequentially.

The licensees requested that the staff advise them on the level of detail that would be needed in the applications.

The staff suggested to the licensees that they address the following points:

L 1. The responsibilities and authorities of the elements of-the new-organization, l

2. Identify where tasks were in the old organization and where they will be in the new organization.

3. Address the corporate aspects of programatic areas, such as security and'

, fire protection, in the transfer from the old offsite to the new offsite j organization.

The licenseer expressed concerns that we were asking more of them than had been- >

done for other licensees like GPU Nuclear. The staff offereo to investigate i

the level of detail that was required in the change for GPU Nuclear. and get back to the licensee.

The licensee indicated that their start date was indeterminate because of other factors, but that following a decision to proceed, tney would plan to have the amenoment applications filed within two weeks. There would be amendment applications for the five operating: licenses and the construction permit. The; i OL application amendment.and the F5AR amendment'for Vogtle Unit 2 would be filed at a later date. They then requested that the staff conduct its review as expecitiously as possible, preferably within three months.

In Revision 1 to LER 50-424/1990-006 dated June-29, 1990 (ELV;01729), GPC attempted to clarify the correct = number. of DG starts occurring:in this: time period by using regulatory guide terminology -(i.e., valid vs. successfuli starts). This revised LER accurately reports the number of valid:DG starts .,

during the period of March 21 through June 7, 1990.~ However, during a-recent '

NRC inspection it was pointed out that the revised LER did not adequately "

clarify the numbers in the April 9th letter. '

Ei The confusion in the April 9th letter and the original LER appear to-be the {

result of two factors. First, there was confusion in-the' distinction between a1 i successful start and a valid test. For the purpose of;this;1etter, a start.was 1 considered successful when the DG was. started and either.ran~or'was intention-ally shut down due to testing' in progress', as; identified on the attached tables.

Our use of the term " successful".was never intended to imply a " valid successful- 9 test" in the context of Regulatory Guide 1.108. ' Many; start attempts:were made to' test the DG's IA and IB using applicable operating procedures.- :These ; j procedures and data sheets do not contain criteria for determining:if a start is i successful which resulted in determinations of su cess wkch were-inconsistent ' a with the above. definition. Second, an error was made by the . individual who.  :

performed the count of DG starts for the NRC April 9th letter.

' Technical Specification 3.4.1.4.2.c, requires that, in Mode 5 with reactor-i coolant loops not filled, Reactor Makeup _ Water Storage Tank discharge valves,.

1-1208-U4-175, 176, 177, and 183 be closed and-secured in position.

Contrary to the above, on February 26, 1990, with Unit 1 in Mode 5 and'RCS level.  ;

at 195 feet 5 inches, valve 1-1208-U4-176 was closed but was not mechanically i secured in the closed position.

This a Severity Level IV violation (Supplement I)".-

RESPONSE TO VIOLATION 50-424/90-05-01 Admission or Denial of the Violation:

The violation occurred as stated.

Reason for the Violation. 4 As stated in the Notice of Violation, Technical Specification 3.4.1.4.2.c.

requires the subject valve to be closed and secured in positk. . Similarly. .

Technical Specification (TS) 3.6.1.7 requires the 24-inch containment purge  ;!

supply and exhaust isolation valves to be closed and sealed closed. The bases  :

- under administrative control to assure they cannot be inadvertently opened. zThe administrative controls, which constituted the locked valve policy, permitted-clearance " hold tags" to be utilized to secure small' valves which cannot.

30- May 1,1990, a violation of NRC requirements was -identified. In' accordance with the " General Statement of' Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1990), the Nuclear Regulatory Commission proposes to impose a civil penalty pursuant to Section 234 of the Atomic Energy l Act of 1954, as-amended (Act), 42 U.S.C. 2282, and.10:CFR 2.205. i The following corrective actions were initiated:

1) A complete audit of the contents of the safeguards information container.

was performed. This audit accounted.for all assigned safeguards i information documents. The unassigned.. safeguards information has been t

properly dispositioned.

2) The individual involved with the event'was disciplined in accordance with Vogtle's Positive Discipline Program. 4 Additional corrective measures taken not specifically.related to the' cited' violation are as follows;
1) An interoffice correspondence was sent to VEGP site and> Corporate office employees emphasizing the following:

o importance of- controlling safeguards information.-

1 o requesting personnel to search and certify'that they have no uncontrolled safeguards information material in their: personal work areas and homes. This certificat_ ion was-. completed by VEGP.siteiand Corporate office employees on July-5, 1990.

o proper method for storing safeguards information.

o proper method for mailing and receiving safeguards information..

o actions to take if any safeguards information does not meet the criteria established in Administrative Procedure 00650-C, and '

VHS-AP-26, " Safeguards Information Control."

2) Safeguards information containers on site were centralized to Document Control, Security, and Quality Assurance offices. These containers were centralized as of May 18, 1990. Corporate office safeguards information- 1 containers were already centralized in Corporate Document. Control before-t this violation occurred. .

3) A review is being performed of. historical records in Corporate office-files. To date, four reference documents dated April-1982, have been located which were marked safeguards information and had not'been properly controlled. One-of these documents is considered to be significant., These documents have nou been secured. .

Other items which may'be discovered during this on going review of l

safeguards information control. willibe reported to the NRC. in an  ;

supplemental repor.t.

4) The VEGP Architect / Engineer Design Organizations were also directed to implement the same interoffice correspondence: certifying safeguards-information control by their respective employees.

Both organizations reported that the applicable employees had certified that their assigned safeguards information documents were-( 1 properly controlled and that they were familiar with the requirements l

for proper handling of safeguards information' documents per their-  :

respective safeguards information control procedure. e

5) Due to our increased sensitivity to safeguards information control after-the cited violation, the VEGP Safety Audit and Engineering Review Department was requested to place special emphasis on safeguards '

information control in their annual audits. Therefore, during-a recent annual audit'of one of the Architect / Engineer Design Organizations utilized by the licensee, possible programmatic problems with safeguards information control and reportability were discovered. The audit revealed inventory log problems and an unsecured safeguards 'information container incident lasting for approximately 35. minutes on November 29, 1989 which had not been reported to the licensee for reportability'and security system compromise-significance due to lack of procedural guidance. This unsecured safeguards information container event was.  ;

reported by the licensee to the NRC on' July 23, 1990.

The Corrective Steos That Will Be Taken'To Avoid Further Violations:

The results of these corrective actions have precipitated further review of <l safeguards information document control procedures for deficiencies in control or reportability at all applicable offsite organizations.

o Licensee direction given to offsite organizations to limit' access to:

i safeguards information containers. This will- be: completed by September 1, 1990, ,

o Licensee requirement that offsite organizations inventory the contents of safeguards information containers and maintain logs of access:in-the~

future. This will be complete by September 1.1990. 'l o The requirement that offsite organizations assign a Security / Safeguards- i information coordinator to be responsible for safeguards information '

container logs. This will be complete by September 1,1990.

o Licensee direction.to offsite organizations to develop and implement guidelines to assure "in-progress" security design: change request working packages are properly controlled. This will' be complete by q September 1, 1990.

o A review of archived security records to verify historical security documents have been properly dispositioned. This will bef complete by -

October 1, 1990.

A supplementary report will be provided to the NRC.by October'31, 1990 summarizing the completion of this review and necessary. corrective actions-  ;

taken.

The Date When Full Como11ance Will Be Achieved:

Full compliance for the noted violation was achieved on April 25, 1990 with completion of the unsecured safeguards information container audit and securing of the container.
