Dear Chairman Margulies:

The Applicants are in accord with your letter of December 12, 1985 to Mr. Bordenick in which you stated that you expect the hearing in this proceeding to commence sometime in March.

The Board has dismissed a number of the technical issues by summary disposition, and has ordered that certain aspects of Contention 7 be litigated. The Board has before it Applicants' summary dispositicn motions on the remaining technical issues, Conte'tions 10.1, 10.5, and 12. The time for all filings by the parties with respect to these issues has long since expired.

This is consistent with the beginning of the hearing on technical issues in March.

In respect of the emergency planning issues, although discovery is in progress and will be completed by January 31, the Applicants are preparing to file motions for summary disposition of emergency planning issues in early January..Accordingly, the Applicants believe that whatever emergency planning issues remain after summary disposition will likewise be ready for a hearing commencing in March.

However, should the Board require additional time for the resolution of summary disposition motions on the emergency planning issues, the Applicants would propose commencement of hearings on the technical issues in March and a separate

' hearing, if necessary, on any remaining emergency planning issues in April.
