Dear Administrative Judges:
Chairman Margulies' letter of May 29, 1986 advised Appli-cants of the Board's view that Applicants' March 10, 1986 motion for summary disposition of Contention EP-5 was incomplete.
Spe-cifically, the letter stated that Contention EP-5 (as restated by the Board in its August 12, 1985 Memorandum and Order) relates to reception centers encompassed in all of the emergency response plans for the Vogtle Plant (not just the Burke County plan), and that Applicants' motion for summary disposition is silent as to the emergency preparedness plan of the Savannah River Plant (SRP) federal reservation.

Applicants did not address the SRP plan in their motion be-cause Applicants did not perceive the SRP reception centers to be related.to the issue raised in the contention as framed by the Joint Intervenors. ' Joint Intervenors' contention was a single sentence related to the "early evacuation" of students at Burke County Comprehensive High School, one of the Burke County recep-tion centers:
Furthermore, the [ Burke County] Plan does not specify whether the designated Reception Center, the Burke County Comprehensive High School, has developed an adequate plan for early evacuation.
Joint Intervenors' Revised Contention Relating to Emergency Re-sponse at 4.
The "early evacuation" aspect of the contention, puzzling because evacuation is not required for a school outside i
of the EPZ, has been taken by the parties and the Board to raise the issue of whether it is necessary, not to " evacuate" school children, but to dismiss them from school to make room at the re-4-
ception center for evacuees.
l The Board's restatement of the contention, at pages 27-29 of its August 12, 1985 Memorandum and Order, refers to " reception centers," without limitation to the Burke County Comprehensive High School.
The Board's discussion, however, was clearly in the context of the issue raised by Joint Intervenor, i.e.,
early dis-missal of students if necessary, and the reflection of that pos-sible necessity in the emergency preparedness plan.

Accordingly, Applicants addressed all of the reception cen-ters (all of which are schools) for the plans of all four a
counties within the-EPZ, and demonstrated that adequate capacity exists without the need for early dismissal of students.
The re-ception centers at SRP are SRP facilities -- not schools -- and-the issue raised by Joint Intervenors therefore was not consid-ered to be applicable to them.
(Moreover, Joint Intervenors were given the opportunity to submit contentions on the SRP emergency plan, and declined to do so.)
Hence, the SRP reception centers were not addressed in Applicants' motion for summary disposition of Contention EP-5.
The enclosed affidavit of Kevin P. Twine provides in-t formation concerning the availability and capacity of reception centers at SRP.
The affidavit shows that there are a number of designated reception centers at SRP, outside of the Plant Vogtle EPZ, any one of which has adequate capacity to accommodate the r
