REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE

(MONTICELLO NUCLEAR GENERATING PLANT) (TAC NO. M96238)

Dear Mr. Anderson:

1 By Northern States Power Company's (NSP's) application dated May 5,1998, and General Electric Company's (GE's) affidavit dated April 28,1998, executed by George B. Stramback, NSP submitted additional information on the use of containment response codes for rerate applications in support of its power rerate amendment application and requested that Attachment 1 to GE letter GLN-98-005 from P.T. Tran to S. J. Hammer, "GE Response to February 1998 Request for Additional Information on Monticello Power Rerate Program

! . Question # 13," dated April 28,1998, be withheld from public disclosure pursuant to 10 CFR 2.790.

GE stated that the information submitted in Attachment 1 to GLN 98-005 should be considered

exempt from mandatory public disclosure for the following reasons:
1. The information discloses a process, method, or apparatus, including supporting data j and analyses, where prevention of its use by GE's competitors without license from GE i constitutes a competitive economic advantage over other companies. l
2. The information, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product. /

This information shows in specific detail the processes, codes, and methods employed

' to perform the evaluations which results are in NEDC-32546P, Power Rerate Safety Analysis Report for Monticello Nuclear Generating Plant, Revision 1 (GE proprietary information] dated December 1997. The development of the detail processes, codes,

and methods employed to perform the evaluations were developed at a significant cost
to GE, on the order of a million dollars.

10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercialinformation.

i Therefore, Attachment 1 to GE letter GLN-98-005, marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

if the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also shou'd understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. la all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
