REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (MONTICELLO NUCLEAR GENERATING PLANT)(TAC NO. M96238)

Dear Mr. Anderson:

By Northern States Power Company's (NSP's) application dated December 4,1997, and General Electric Company's (GE's) affidavit dated December 3,1997, executed by George B.

Stramback for NEDC-32546P, Revision 1, and by NSP's supplemental letter dated March 6, 1998, with GE's affidavit dated October 17,1997, also executed by George B. Stramback for NEDC-32514P, Revision 1, NSP submitted Revision 1 to its July 26,1996, license amendment request on the Monticello Power Rerate Program and requested that Exhibit E (NEDC-32546P, Revision 1, " Power Rerate Safety Analysis Report for Monticello Nuclear Generating Plant",

December 1997) and Exhibit G (NEDC-32514P, Revision 1, "Monticello SAFER /GESTR-LOCA Loss-of-Coolant Accident Analysis", October 1997 ) be withheld from public disclosure pursuant to 10 CFR 2.790.

NSP's application did not include nonproprietary versions of Exhibits E and G, and we request that nonproprietary versions of the above two reports be submitted to NRC for release to the NRC Public Document Room within 60 days from the date of this letter.

GE stated that the submitted information should be considered exempt from mandatory public l disclosure for the following reasons:

1. The information discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by GE's competitors without license from GE constitutes a competitive economic advantage over other companies. l

improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product. @M

3. The information contains detailed results of analytical models, methods, and processes, j including computer codes, and conclusions from these applications, which represent, as

The development and approval of this overall approach was achieved at a significant cost to GE, in excess of a million dollars, over and above the very large cost of developing the underlying individual proprietary analyses.

1. The information discloses a process, method or apparatus where prevention of its use by General Electric's competitors without license from General Electric constitutes a competitive economic advantage over other companies.
2. The information, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, mstallation, assurance of quality or licensing of a similar product.
3. The information contains detailed results of analytical models, methods, and processes, including computer codes, which GE has developed, obtained NRC approval of, and applied to perform evaluations of instrument setpoints for boiling-water reactors (BWRs).

The development and approval of the BWR generic power uprate methodology was achieved at a significant cost, on the order of several million dollars, to GE; and the development of the evaluation process along with the interpretation and application of the analytical results is derived from the extensive experience database that constitutes 1 a major GE asset.

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information. l Therefore, Exhibit E, NEDC-32546P, Rev.1, " Power Rerate Safety Analysis Report for Monticello Nuclear Generating Plant," December 1997, and Exhibit G, NEDC-32514P, Rev.1, "Monticello SAFER /GESTR-LOCA Loss ~-of-Coolant Accident Analysis," October 1997, marked i as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information.
