Dear Ms. Garde:

This is in further response to your letters dated February 26 69d 28, 1986, which appealed Mr. Donnie H. Grimsley's letters dated Decemi,cr 3 and 24, 1985, and February 24, 1986, with regard to the denial of portions of 12 documents and 3 documents in their entirety. These

, documents were subject to your Freedom of Information Act (F0IA) request for documents related to the NRC Comanche Peak Task Force.

My letter to you dated December 9, 1986, responded to 13 documents and stated that the NRC was contacting the originators of the other two documents concerning a proprietary claim. The response from Texas Utilities Generating Company (TUGCO) has been received and reviewed, and I have determined that some additional information may now be made publicly available. Your appeal is, therefore, partially granted and partially denied.

Documents A-11 and A-77 c.onsist primarily of test questions, answers and scores, and certification results of quality assurance personnel and were initially denied purstant to Exemption (4) of the F0IA (5 U.S.C. 552(b)(4)).

Upon review of the TUGLO response, it has now been detennined that the information in the documents is no longer considered commercial financial (proprietary)information. However, the documents do contain information that is exempt from public diclosure pursuant to Exemption (6) of the F0IA (5 U.S.C. 552(b)(6)) and 10 CFR 9.5(a)(6) of the Comission's regulations. The withheld information consists of the names and other identifying information of individuals who took the tests. I am unable to identify any legitimate public interest in this information which outweighs the privacy interests of the individuals. The nonexempt information is enclosed.

This is a final agency action. As set forth in the F0IA (5 U.S.C.

552(a)(4)(B)), judicial review of this decision is available in a district court of the United States in the district in which you reside, have your principal place of business, or in the District of Columbia.
