3) AECM-85/0074, dated March 27, 1985 Attached is a check for $32,600.00 for payment of fees for certain applications for Grand Gulf Nuclear Station Unit 1. This check represents payment in part by Mississippi Power & Light Company (MP&L) of a bill received from the Nuclear Regulatory Commission (NRC) in a letter dated July 16, 1986, (Reference 1) as authorized in 10 CFR 170.

MP&L has reviewed the itemized assessments in Reference 1 against prior invoices. In MP&L's opinion, there has been an overcharge of $4,000 with regard to the review of TAC #51477, Inservice Inspection and Testing Program for Pumps and Valves (Attachment 2). The fee applicable for this review is listed as $12,300 corresponding to the fee for a Class IV amendment at the time of the submittal.

In a prior invoice (Reference 2), MP&L was billed $4,000 for review of the same submittal (Attachment 3, Item 12). This corresponded to the charge for a Class III amendment at the time of the submittal.

MP&L recognizes that the NRC could reclassify its review from Class III, a single safety issue, to Class IV, several safety issues, but it is MP&L's position that credit should have been given for the $4,000 previously paid via Reference 3 for the review of TAC #51477. Thus, billing for TAC #51477 should have been $8,300.00 rather than $12,300.00.
