Gentlemen:
The referenced correspondence transmitted a BWROG report for your review in support of alternate source term implementation. Specifically, the report provided the resuits of an analysis to determine minimum time to fuel perforation, on a generic basis, for all BWRs. NUREG 1465 had quantified this parameter for the PWRs and noted that fuel failures for BWRs would occur significantly later. The attached information is being transmitted to support the NRC review of that submittal.
The attached information had been submitted earlier to the NRC contractor (INEEL) performing the technical review of the referenced submittal. This transmittal is to support the NRC review of the tecimical evaluation and the preparation of a safety evaluation approving the use of the BWROG report. The BWROG report has also been referenced in a November 3,1998 pilot plant submittal by Grand Gulf Nuclear Station (GNRO-98/00085) requesting approval of a partial scope application of the alternate source tenn insights of NUREG 1465.

AFFIDAVIT OF WILLIAM H. RASIN
- 1. I am Vice President-Nuclear, Fuel and Quality Assurance Services, Duke Engineering &
Services ("DE&S"), and as such have the responsibility of reviewing the proprietary information sought to be withheld from public disclosure in connection with nuclear plant licensing, and am authorized to apply for its withholding on behalf of DE&S.
- 2. I am making this affidavit in conformance with the provisions of 10 CFR 2.790 of the regulations of the Nuclear Regulatory Commission ("NRC") and in conjunction with DE&S' application for withholding which accompanies this affidavit.
3, I have knowledge of the criteria used by DE&S in designating information as proprietary or confidential.
- 4. Pursuant to the provisions ofparagraph (b) (4) of 10 CFR 2.790, the following is furnished for consideration by the NRC in determining whether the information sought to be withheld from public disclosure should be withheld.
(i)
The information sought to be withheld from public disclosure is owned by DE&S and has been held in confidence by DE&S and its consultants.
(ii)
The infomiation is of a type.that would customarily be held in confidence by DE&S.
The information consists of analysis methodology details, supporting data, and aspects of development programs, relative to a method of analysis that provides a competitive advantage to DE&S.
(iii)
The information was transmitted to the NRC in confidence and under the provisions of 10 CFR 2.790, it is to be received in confidence by the NRC.
(iv)
The information sought to be protected is not available in public to the best of our knowledge and belief.
(v)
The proprietary information sought to be withheld in the submittal is that which is contained in the computer disk enclosed and in the supporting documentation.
This information enables DE&S to:
.(a) Support license amendment and Technical Specification revision requests for General Electric BWRs.
(b) Perform and :;upport "::ensee safety reviews per 10 CFR 50.59.
(c) Enhance operation of and training programs related to nuclear power plants.
(d) Respond to NRC requests for information regarding the long-term containment
_ response of General Electric BWRs.-

The proprietary information sought to be withheld from the public disclosure has j
substantial commercial value to DE&S.
j (a' ) DE&S intends to sell the infonnation to nuclear utilities, vendors, and consultants for the purpose of supporting the operation and licensing of nuclear power plants.

. (b) The subject luformation could only be duplicated by competitors at similar expense to that incurred by DE&S.

. 5. Public disclosure of this information is likely to cause hann to DE&S because it would allow cpmpetitors in the nuclear industry to benefit from the results of a significant development program without requiring a commensurate expense or allowing DE&S to recoup a portion ofits expenditures or benefit from the sale of the information.
