REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NOS. MF1879, MF1880, MF1881, AND MF1882)

Dear Mr. Gallagher:

By letters dated July 15, 2014, and July 25, 2014, which can be found in the Agencywide Documents Access and Management System (ADAMS) under Accession Nos. ML14196A553 and ML14206A918, respectively, you submitted affidavits dated July 15, 2014, and July 25, 2014, respectively, executed by James A. Gresham of Westinghouse Electric Company, requesting that the information contained in the following documents be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390:

Enclosure A to Resubmittal of Information associated with NRC Set 10 RAIs, related to the Byron Station, Units 1 and 2, and Braidwood Station, Units 1 and 2, License Renewal Application (ADAMS Accession No. ML14196A553)

Enclosure A to Response to NRC Request for Additional Information, Set 31, dated June 30, 2014, related to the Byron Station, Units 1 and 2, and Braidwood Station, Units 1 and 2, License Renewal Application (ADAMS Accession No. ML14206A918)

The reasons for requesting our withholding of this information were that the information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies; its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product; and it reveals aspects of past, present, or future Westinghouse or customer funded development plans and programs of potential commercial value to Westinghouse.

We have reviewed your application and all of the supporting information in accordance with the requirements of 10 CFR 2.390 and have concluded that you have not provided sufficient justification for us to determine that the information sought to be withheld from public disclosure contains proprietary information. Some of the information is already publically available, such as cycle limits for the current licensing basis, transient tables listed in the license renewal application, and information already publically available in licensing documents or the updated final safety analysis report. In addition, some of the information is not customarily withheld, such as general review processes and general summaries of the documents or data it reviewed;

M. Gallagher these summaries did not include any specific details that would bound them as proprietary information per the reasons listed in the affidavit. In addition, other information that is not customarily withheld includes the results from the evaluations, including the locations evaluated and found to be the limiting locations, and the numerical results from the evaluations.

Accordingly, we have concluded that the information sought to be withheld from public disclosure does not meet the requirements of 10 CFR 2.390. Therefore, your request to withhold the resubmittal of RAI responses for Set 10 and the submittal of RAI responses for Set 31 from public disclosure is denied.

By October 1, 2014, the subject documents will be placed in the U.S. Nuclear Regulatory Commission's Public Document Room. If, by October 1, 2014, you request withdrawal of the documents in accordance with 10 CFR 2.390(c), your request will be considered in light of applicable statutes and regulations and a determination made whether the documents will be withheld from public disclosure and returned to you.
