REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NOS. MF1879, MF1880, MF1881, AND MF1882)

Dear Mr. Gallagher:

By letter dated March 28, 2014, Agencywide Documents Access and Management System (ADAMS) Accession No. ML14090A237, you submitted an affidavit dated March 28, 2014, executed by James A. Gresham of Westinghouse Electric Company, requesting that the information contained in the following document be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390:

Responses to NRC Requests for Additional Information, Set 10, dated February 26, 2014 related to the Braidwood Station, Units 1 and 2 and Byron Station, Units 1 and 2 License Renewal Application, Enclosure B.

The reasons for requesting our withholding of this information were that Westinghouse Electric Company has sole ownership of the information and is not customarily disclosed to the public; the information reveals certain distinguishing aspects of a process, methodology, or component, the exclusive use of which provides a competitive advantage for Westinghouse Electric Company; and that the information reveals certain distinguishing aspects of a process, methodology, or component, the exclusive use of which provides a competitive advantage for Westinghouse Electric Company in product optimization or marketability.

We have reviewed your application and all of the supporting information in accordance with the requirements of 10 CFR 2.390 and have concluded that you have not provided sufficient justification for us to determine that the information sought to be withheld from public disclosure contains proprietary information. Some of the information is already publicly available, such as cycle limits for the current licensing basis, the NRC staffs request for additional information, tables listed in the license renewal application, citing publicly available documents such as NRC NUREG publications.

Accordingly, we have concluded that the information sought to be withheld from public disclosure does not meet the requirements of 10 CFR 2.390. Therefore, your request to withhold Enclosure B from public disclosure is denied.

Within 30 days from the receipt of this letter, the subject documents will be placed in the U.S.

Nuclear Regulatory Commission's Public Document Room. If, within 30 days of the receipt of this letter, you request withdrawal of the documents in accordance with 10 CFR 2.390(c), your request will be considered in light of applicable statutes and regulations and a determination made whether the documents will be withheld from public disclosure and returned to you.
