Dear Mrs. Ellis and Mr. Counsil:

This is in response to the dispute between Citizens Association for Sound Energy (CASE) and TV Electric regarding the acceptability of the 1982 Reactor Coolant System Hydrostatic Test. The dispute, which was submitted by CASE on March 13, 1989 (supplemented by information provided in a March 17, 1989 CASE letter to the NRC) pursuant to Section B of the Joint Stipulation, requested that the NRC take certain actions. CASE requested that the NRC require TV Electric, as a condition of licensing, to perform an ASME Section III Cold Hydrostatic Test to the currently approved site code, standards, and legal requirements, or, alternatively, to request a ruling by the ASME Code Committee or other proper ASME board providing a code case exception for TU Electric in regard to their inability to establish that the 1982 test met applicable codes, standards, and legal requirements. TU Electric responded to the dispute by their letter to the NRC dated May 9, 1989.

For the reasons set forth in the enclosed staff evaluation, we find that the actions requested by CASE are not narranted. After considering all the information available to us, we conclude that the hydrostatic test in question was acceptably performed and inspected in accordance with the ASME Code and NRC requirements applicable at that time, and that records of the test adequately support the acceptable accomplishment of the test.
