Sub.iect: Interim Guidance on Emerqencv Planning Standard 10 CFR 50.47(b)(12) Regarding the Hope Creek Generating Station By letter dated September 76, 1985 (W. Butler, NRC to R. Mitti, PSEAG), we

orovided PSEAG with Interim Guidance with respect to the recent court decisinn l GUARD vs. NRC, 753 F.?d 1144 (D.C. Cir. 1985). The Interim Guidance states

! the CommisiTon's belief that Licensing Boards, and in uncontested cases, the staff may find that aDplicants who:

l (1) have met the requirements o' 10 CFR 50.47(b)/1?) as interpreted bv j the Comission before the GUAPO decision, and 4 ,

j (2) commit to full compliance with the Commission's response to the  :

GUARD remand, i j meet the requirements of 50.47(c)(1) and, the,efore, are entitled to a license

on the condition of full compliance with the Cnmmission's forthcoming response I j to the GUARD remand.

I By letter dated October 75,1985 (R. Mitti, PSE8G to W. Rutlar, NRC) PSEAG j responded to this guidance. We have reviewed your response and conclude that j it acceptably addresses the issues at hand, except for issue (?) above. In ,

the response letter it is stated that "PSEAG will address full compliance with l t the Comission's response to the GUARD remand upon issuance of such response."  !

! (50 FR 20897. published May Pl.1985), PSEAG is reauired to commit to full i compliance with the Commission's resocnse to the GUARD remand before the staff j will consider the issuance of a license authorizing operation in excess of j 5% power.
