The Board previously has imposed the parties' proposed deadline of' January 14, 1985, for the filing of summary dispo-sition motions on emergency preparedness contentions. Prior to today, Applicants had filed 14 such motions (EPJ-1, 3, 4(a) and 4(b); CCNC 8; CHANGE 17; Eddleman 57-C-3, 57-C-7, 57-C-13, 144, 154, 215(1), 224 and 240). With the additional 11 motions being filed today addressing 12 contentions (EPJ-2, 4(c), 4(d) and 5; CCNC 2; Wilson 12(b)(2) and 12(b)(3); Eddlemen 30, 57-C-10, 213, 213-a and 215(3)), Applicants have now sought summary disposition of all outstanding admitted emergency D "

In an effort to explore the potential settlement of Wilson 11, Applicants informally provided Dr. Wilson with technical information from the North Carolina Division of Emergency Man-agement and from HMM Associates, the Carolina Power & Light

' company consultant which performed the evacuation time estimate study. Based upon his review of that material, Dr. Wilson de-cided to withdraw his Contention 11, and so informed Appli-cants' counsel on December 17, 1984. In a subsequent conversa-tion shortly thereafter, Dr. Wilson agreed to prepare and to

, file with the Board a motion to withdraw, or notice of with-4 drawal of, Contention 11.

. Applicants have been unsuccessful in recent attempts to contact Dr.' Wilson by telephone to determine why his filing has

i. not been made. I assume the reason to be the distraction of the recent holidays and/or the press of work. We will continue efforts to communicate with Dr. Wilson on this matter. Howev-er, in view of the passing deadline for summary disposition mo-tions, Applicants record here their reliance on Dr. Wilson's oral representations in foregoing the opportunity to file a timely motion. Based on our past experience, I have no reason to speculate that Dr. Wilson has changed his position without informing us. If that nevertheless turns out to be the case, Applicants will seek the Board's leave to file a late summary disposition motion on Wilson 11.
