Docket No. 50-400-o L.

l Administrative Judges Kelley, Bright and Carpenter:

0 t

(

In its Memorandum and Order (Ruling on Eleven Summary Dis-

)

position Motions), dated February 27, 1985, the Board ruled on pending emergency planning summary disposition motions on which responsive pleadings had been filed or the opportunity to file a responsive pleading had expired.

As the Board noted in that Memorandum and Order, all pleadings on the remaining motions were to be filed by March 11, 1985.

Mr. Glenn O.

Bright Dr. James H. Carpenter March 15, 1985 Page 2 The NRC Staff on or before February 27, 1985, answered all remaining motions.

(Note, however, that Applicants' motion of January 14, 1985 with respect to Eddleman Contention 213 asked that the parties' response times be tolled.

On February 6, 1985, the Staff answered in support of that request.)

On March 11, 1985, intervenor CHANGE filed a response to Applicants' motions for summary disposition of contentions EPJ-l and EPJ-4.

CHANGE apparently is not aware that Appli-cants' motion on EPJ-l was filed on December 10, 1984, was an-r.wered by the Staff on January 16, 1985, and was granted by the Board in the February 27, 1985 Memorandum and Order.

The op-portunity for intervenor response to this motion expired on January 28, 1985.

Further, Applicants note that, as stated in Applicants' summary disposition motion, the Board designated CCNC, not CHANGE, as the lead intervenor on EPJ-1.

See Final Set of Rulings on Admissibility of Offsite Emergency Planning Contentions, Ruling on Petition for Waiver of Need for Power Rule, and Notice of Upcoming Telephone Conference Call, at 54 (Aug. 3, 1984).

Applicants have received no other intervenor responses or requests for' extension of time with respect to the remaining emergency planning summary disposition motions.

The pending motions for which there are no intervenor responses address the following contentions: EPJ-2, 3 and 5; CCNC-2; Wilson 12(b)(2) and 12(b)(3); and Eddleman 30, 57-C-10, 213-a and 215(3).

Respectfully submitted, t,

Thomas A.
