the National Register pursuant to Executive Order 11593 or the National Historic Preservation Act of 1966, as amended. Our determination appears on the enclosed material.

As you understand, your request for our professional judgment constitutes a part of the Federal planning process. We urge that this information be integrated into the National Environmental Policy Act analysis in order to bring about the best possible program decisions. This determination does not serve in any manner as a veto to uses of property, with or without Federal participation or assistance. Any decision on the property in question and the responsibility for program planning concerning such properties lie with the agency or block grant recipient after the Advisory Council on IIistoric Preservation has had an opportunity to comment.

Dear Ms. Schull:

Pursuant to our responsibility under 36 CFR 1204 as licensing agency for the Construction and operation of Waterford Steam Electric Station, Unit 3, the Nuclear Regulatory Consnission requests a determination by your office of the eligibility of Area 3 and Area 4 for inclusion in the National Register of Historic Places. The sites are designated as Area 3, the Waterford Plantation Overseers House Site and Area 4, the Waterford : Plantation Workers Quarters Site.

Detailed information is provided on the enclosed National Register of Historic Places Inventory Nomination Forms (FHR-8-300). Included is a letter dated November 3,1981 from Robert B. DeBlieux, State Historic Preservation Officer to Mr. William H. Regan, Jr., Nuclear Regulatory Commission in which the state requests that determination of eligibility for the sites be sought and a copy of the 1980 survey report.

Areas 3, 4, and 5 Waterford Stean Electric Station, Unit No. 3 St. Charles Parish, Louisiana

Dear Mr. Regan:

Thank you for submitting the National Register eligibility documentation for the three sites referenced above. My staff has reviewed the data and it is our opinion that Area 3, the Waterford Plantation Overseers House Site, and Area 4, the Waterford Plantation Workers Quarters, are eligible for the Register from an archaeological standpoint, based on the presence of in situ remains and the information these remninn have the potential of'providing. It is also our opinion that Area 5, the Waterford Plantation Sugar Mill Site, is not eligi.ble for the National Register due to the lack of in situ features and the disturbed nature of the site as a result of plowing.

This letter of opinion, along with the eligibility documentation, should next be sent to the Keeper of the Register for his official opinion in accordance with 36CFR63 If any or all of the above sites are determined to be eligible, a Determination of Effect will be re-quired, in accordance with 36CFR800.
