On April 27, the U.S. District Court of Appeals handed down a decision that nullifies Table S-3 as a guideline for nuclear waste disposal on which the Nuclear Regulatory Commission has relied.

Therefore, the final impact statement for Midland can not rely on this Table as a basis for complying with NEPA.

I am sending this letter as a supplement to my comments based on this new information. I also plan to include contentions on this issue and this court decision for the operating license hearings.
