SET 2 1. Land Use (LU)

LU-1 As explained in the ER, the Federal Coastal Zone Management Act (CZMA) requires applicants for a federal license to certify to the licensing agency that the proposed activity would be consistent with the state's federally approved coastal zone management program. Regulations require the license applicant to provide its certification to the federal licensing agency and a copy to the applicable state agency.

Section 9.5.10 of the ER, Coastal Zone Management Act, states:

FPL received confirmation of coastal zone certification in a letter dated

March 9, 2012, from the FDEP [Florida Department of Environmental Protection]

to the USACE (FDEP 2012). The operating agreement between the FDEP and participating agencies identifies the final order issued as part of the PPSA [Florida Power Plant Siting Act] as the CZMA consistency for the authorized power plant. Therefore, [Turkey Point] has fulfilled the regulatory requirement to certify to the licensing agency that the proposed activity would be consistent with the state's federally approved coastal zone management program.
