NATIONAL PARK SERVICE COOPERATING AGENCY REQUEST FOR SUBSEQUENT LICENSE RENEWAL OF TURKEY POINT NUCLEAR GENERATING UNITS 3 AND 4 (EPID NO. L-2018-LNE-0001)

Dear Ms. Craighead:

By letter dated January 30, 2018 (Agencywide Documents Access and Management System (ADAMS) Package Accession No. ML18037A812), as supplemented, Florida Power & Light Company (FPL) submitted an application for subsequent renewal of Renewed Facility Operating License Nos. DPR-31 and DPR-41 for Turkey Point Nuclear Generating Units 3 and 4 (Turkey Point). Nuclear power plant licenses may be renewed pursuant to Section 103 of the Atomic Energy Act of 1954, as amended. The regulations governing license renewal include Title 10 of the Code of Federal Regulations (10 CFR) Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants, and Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions. The U.S. Nuclear Regulatory Commission (NRC) has received the National Park Service (NPS) letter dated June 22, 2018 (ADAMS Accession No. ML18193B074), providing comments on the scope of the NRCs environmental review of the proposed subsequent license renewal of Turkey Point. The letter also requested that the NPS be permitted to be a cooperating agency in the development of the NRCs environmental impact statement for the proposed subsequent license renewal of Turkey Point.

The National Environmental Policy Act of 1969, as amended (NEPA) (42 USC § 4321 et seq.),

as implemented by the NRC under 10 CFR Part 51, requires all agencies of the Federal Government to use a systematic, interdisciplinary approach that will insure the integrated use of the natural and social sciences in planning and decisionmaking which may have an impact on the human environment. Prior to making any detailed statement, the responsible Federal official shall consult with and obtain the comments of any Federal agency that has jurisdiction by law or special expertise with respect to any environmental impact involved. The NRC specifically adopted NEPA requirements for lead and cooperating agencies in 10 CFR 51.10(b)(2), which states, in part, that the Commission will Follow the provisions of 40 CFR 1501.5 and 1501.6 relating to lead agencies and cooperating agencies.

The NRC acknowledges NPSs special expertise regarding the natural environment in Biscayne National Park and agrees that NPS will be able to provide valuable information as a cooperating agency. As such, the NRC looks forward to working with NPS to develop a

Memorandum of Understanding (MOU) to establish a framework for cooperation, early coordination, and participation in the development of the NRCs supplement to the generic environmental impact statement for license renewal of nuclear plants for Turkey Point.
