ME6234 -ME6238) On September 26, 2011, a Category 1 meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Constellation Energy Nuclear Group, LLC (CENG) and Exelon Corporation at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. As stated in the meeting notice dated September 12, 2011 (Agencywide Document Access and Management System (ADAMS) Accession No. ML 112500517), the meeting was closed to the public since the information to be discussed had previously been determined to contain proprietary commercial information and be withheld from public disclosure in accordance with 10 CFR 2.390 as stated in the NRC letter dated August 19, 2011 (ML 112270380). As part of the NRC staff's review of the proposed merger between Exelon Corporation and Constellation Energy Group, Inc. (CEG) (ML 11138A159), the staff has focused on foreign ownership, control or influence (FOCI). CENG's supplemental letter of August 12,2011 (ML 11234A062), led to further staff FOCI concerns that needed to be discussed and resolved. On September 26, 2011, a Category 1 meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Constellation Energy Nuclear Group, LLC (CENG) and Exelon Corporation at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. As stated in the meeting notice dated September 12, 2011 (Agencywide Document Access and Management System (ADAMS) Accession No. ML112500517), the meeting was closed to the public since the information to be discussed had previously been determined to contain proprietary commercial information and be withheld from public disclosure in accordance with 10 CFR 2.390 as stated in the NRC letter dated August 19, 2011 (ML112270380).
As part of the NRC staff's review of the proposed merger between Exelon Corporation and Constellation Energy Group, Inc. (CEG) (ML11138A159), the staff has focused on foreign ownership, control or influence (FOCI). CENG's supplemental letter of August 12,2011 (ML11234A062), led to further staff FOCI concerns that needed to be discussed and resolved.
The staff discussed the role and function of the CENG Nuclear Advisory Committee along with FOCI concerns associated with EDF, CENG, and Exelon. A list of attendees is provided in the Enclosure. There were no slides or handouts.
