By letter dated May 12, 2011 (TAC Nos. ME6234, ME6235, ME6236, ME6237, and ME6238),

Exelon Generation Company, LLC and Constellation Energy Nuclear Group, LLC (CENG),

jointly submitted an application requesting NRC consent, pursuant to 10 CFR 50.80 and 72.50, for a proposed merger between Exelon Corporation and one of CENGs parent companies, Constellation Energy Group, Inc (CEG). The proposed merger would result in CEG becoming a wholly-owned subsidiary of Exelon Generation Company, LLC, and the resultant indirect license transfers of Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2, R.E. Ginna Nuclear Power Plant, Nine Mile Point Nuclear Station, Unit Nos. 1 and 2, and the independent spent fuel storage installations at both the Calvert Cliffs and Ginna stations.

The purpose of this e-mail is to provide the results of the Nuclear Regulatory Commission (NRC) staffs acceptance review of this application. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that it provides technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed license transfer in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.
