SUMMARY

OF MAY 8, 2020, MEETING WITH EXELON GENERATION COMPANY, LLC REGARDING PROPOSED EMERGENCY LICENSE AMENDMENT REQUEST INVOLVING CONTROL ROOM AIR TREATMENT SYSTEM (EPID L-2020-LLA-0103)

On May 8, 2020, a telephone conference was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Exelon Generation Company, LLC (Exelon, the licensee). The purpose of the meeting was to discuss Exelons plan to submit a license amendment request (LAR) involving the control room air treatment system at Nine Mile Point Nuclear Station (Nine Mile Point), Unit 1, under emergency circumstances per Section 50.91(a)(5) of Title 10 of the Code of Federal Regulations. Because of emergency circumstances, the telephone conference was not noticed as a public meeting. A list of attendees is enclosed.

During the telephone conference, the licensee described (1) the circumstances causing the need for the proposed emergency LAR, (2) the proposed change to the technical specifications (TSs), (3) the compensatory measures the licensee planned to implement, and (4) the date the proposed LAR would be submitted and requested date for the NRC staff to complete the review of the LAR.

According to Exelon, on May 3, 2020, a fan motor in the control room air treatment system failed. Because of the failed fan motor, the licensee is required by Nine Mile Point, Unit 1, TS Limiting Condition for Operation (LCO) 3.4.5.e to restore the system to operable within 7 days.

Exelon stated that the failure was unpredictable and there were no indications of degraded performance prior to the failure. Because efforts to restore the system to operable could exceed the required time in LCO 3.4.5.e, the licensee planned to request an extension to that time. The licensee described several compensatory measures that it would include in the proposed LAR.

The licensee requested that the NRC staff complete the review of the proposed LAR by the morning of May 10, 2020. Because the failure was unpredictable and the proposed change was needed within 2 days, the licensee believed that it met the criteria for emergency circumstances.

Subsequent to the telephone conference, the licensee informed the NRC staff that it was able to restore the system to operable within the time required by Nine Mile Point, Unit 1, TS LCO 3.4.5.e. Thus, Exelon no longer needed to request a change to the Nine Mile Point, Unit 1, TSs and did not submit the proposed LAR to the NRC.

No members of the public were in attendance except for representatives from the State of New York. No public meeting feedback forms were received.
