SUMMARY
OF JANUARY 6, 2021, PRESUBMITTAL MEETING BETWEEN THE U. S. NUCLEAR REGULATORY COMMISSION AND EXELON GENERATION COMPANY, LLC REGARDING LICENSING ACTIVITIES TO SUPPORT THE PLANNED EARLY CLOSURES OF BYRON, UNITS 1 AND 2, AND DRESDEN, UNITS 2 AND 3 (EPID L-2020-LRM-0113)
On January 6, 2021, a Category 1 public meeting was held between the staff of the U.S.
Nuclear Regulatory Commission (NRC) and representatives of Exelon Generation Company LLC (Exelon), via teleconference. The purpose for this teleconference was for Exelon to brief the NRC staff on an emergency plan (EP) exemption and license amendment request (LAR) in support of post-defueled conditions following the scheduled early closures of the Byron and Dresden nuclear power stations.
The meeting was published on the NRCs public webpage on December 15, 2020 (Agencywide Documents Access Management System (ADAMS) Accession No. ML20350B643). No licensee-furnished presentation materials were received by the NRC staff.

Background===
The NRC was notified of the planned early closures of both the Byron and Dresden stations by Exelon letters dated September 2, 2020 (ADAMS Accession Nos. ML20246G613 and ML20246G627, respectively).
Summary In support of the scheduled post-defueled conditions for each of these stations, Exelon presented information to the NRC staff for: (1) EP exemption planning and (2) EP LAR planning; as each pertain to post-defueled conditions that will exist at the Byron and Dresden stations following the planned early closures. Exelon discussed that each licensing action submittal would follow recently NRC-approved precedence regarding EP exemptions and license amendments used within industry. This will be accomplished by utilizing available benchmarking and industry lessons learned from previous decommissioning transition experience (i.e., Oyster Creek, Three Mile Island 1, other sites). Exelon discussed they would use revised Emergency Action Levels (EALs) which will conform to NRC-endorsed NEI 99-01, Revision 6,1 and there would be no EAL deviations. Exelon also discussed that the revised EPs would continue to follow industry norms for notifications at both the State and Federal level.

Exelon explained that the submittals will address various topical areas including:
communications, meteorology, staffing levels, emergency response organizations (EROs),
training, exercises/drills, etc. Exelon stated in their presentation that the projected submittal timelines for the EP exemption and EP license amendment for each station would be in mid-March 2021 (Dresden) and mid-May 2021 (Byron). Exelon concluded by reiterating that the announced planned early closure for Byron, Units 1 and 2, is scheduled to occur by September 30, 2021, and for Dresden, Units 2 and 3, is scheduled to occur by November 30, 2021.
The NRC staff engaged with Exelon to discuss mitigative strategies that have been employed throughout industry associated with spent fuel pool level indication and recovery from any potential loss of water inventory. The NRC staff discussed the benefits of NRC-approved information used at other sites; including previous NRC rulemakings and guidance such as the mitigation of beyond-design-basis events also known as the MBDBE Rule 2 and NEI 06-12.3 Exelon acknowledged the staffs discussion on the topic and indicated the forthcoming EP licensing submittals would be informed accordingly.
There were no final determinations or regulatory decisions made by the NRC staff during the meeting.
Public Participation During the public question and comment period, the NRC staff received and responded to a member of the public pertaining to:
o Availability of Exelon (or NRC) furnished presentation materials for this meeting.
o Exelons intention to reverse the currently scheduled early closures of the Byron and Dresden stations should economic conditions in the State of Illinois change in 2021.
