SUMMARY
OF FEBRUARY 23, 2023, WITH CONSTELLATION ENERGY GENERATION, LLC ON PROPOSED CHANGES TO EMERGENCY PLANS TO REVISE EMERGENCY ACTION LEVELS (EPID L-2023-LRM-0009)
On February 23, 2023, a public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Constellation Energy Generation, LLC (CEG, the licensee) via teleconference. The purpose of this meeting was to discuss CEGs plans to submit license amendment requests (LARs) to revise the emergency action levels (EALs) in the emergency plans for Braidwood Station, Units 1 and 2; Byron Station, Unit Nos. 1 and 2; Calvert Cliffs Nuclear Power Plant, Units 1 and 2; Clinton Power Station, Unit No. 1; Dresden Nuclear Power Station, Units 2 and 3; James A. FitzPatrick Nuclear Power Plant; LaSalle County Station, Units 1 and 2; Limerick Generating Station, Units 1 and 2; Nine Mile Point Nuclear Station, Units 1 and 2; Peach Bottom Atomic Power Station, Units 2 and 3; Quad Cities Nuclear Power Station, Units 1 and 2; and R. E. Ginna Nuclear Power Plant (collectively, the CEG facilities). The meeting notice and agenda dated February 8, 2023, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML23040A130, and CEGs meeting handout is available at ML23052A175. A list of attendees is enclosed.
The licensee presented information regarding the schedule and contents of the upcoming LARs to revise the EALs in the emergency plans for the CEG facilities. The licensee stated that in preparing these submittals they expect to have no deviations from the guidance contained in Nuclear Energy Institute (NEI) 99-01, Revision 7, Development of Emergency Action Levels for Non-Passive Reactors (ML23027A078). CEG indicated that it plans to submit the LARs requests in June 2023. The NRC staff indicated that the review of NEI 99-01, Revision 7, would likely not be completed until the end of 2023. CEG stated that does not plan to submit the LARs until the NRC has completed the review.
The NRC staff appreciated that the licensee held the meeting early in the development process so that any staff comment could be considered in the application.
