APPENDIX A Western Engine Company Docket No. 99901079/87-01 NOTICE OF VIOLATION As a result of the inspection conducted on January 26-30, 1987, and in accord-ance with Section 206 of the Energy Reorganization Act of 1974 and its imple-menting regulation 10 CFR Part 21, the following violation was identified and categorized in accordance with the NRC Enforcenent Policy (10 CFR Part 2, Appendix C), 49 FR P583 (March 8, 1984):
Section 21.6(a) of 10 CFR Part 21, dated May 31, 1984, states "Each individual, partnership, corporation or other entity subject to the regulations in this part, shall post current copies of the following documents in a conspicuous position on the premises, within the United States where the activities subject to this part are conducted (1) the regulations in this part, (2) section 206 of the Energy Reorganization Act of 1974, and (3) procedures adopted pursuant to the regulations in this part."
Contrary to the above, Western Enaine Company accepted and fulfilled two nuclear purchase orders (P0s) 103394 and 308615 that invoked the requirerents of 10 CFR Part 21, yet there was no evidence of a Part 21 program in effect at Western Engine Company.
