APPENDIX A Conax Buffalo Corporation Docket No. 99900323/86-01

- NOTICE OF VIOLATION As a result of the inspection conducted on April 14-30, 1986, and in accordance with Section 206 of the Energy Reorganization Act of 1974 and its implementing regulation 10 CFR Part 21, the following violations were identified and categor-ized in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C),

49 FR 8583 (March 8, 1984):

A. Section 21.21 of 10 CFR Part 21, states, in part:

"...(a) Each individual, corporation, partnership or other entity subject to the regulations in this part shall adopt appropriate procedures to:

(1) Provide for: (i) evaluating deviations or (ii) informing the licensee or purchaser of the deviation to be evaluated...(b)(1) A director or re-sponsible officer subject to the regulations of this part or a designated person shall notify the Commission when he obtains information reasonablyr indicating a failure to comply or a defect affecting (i) the construction

  • or operation of a facility...or (ii) a basic component that is within his organization's responsibility and is supplied for a facility...within the United States that is subject to the licensing requirements...."

Contrary to the above, the Conax Buffalo Corporation (CBC) failed to perform a 10 CFR Part 21 reportability evaluation for a deviation in a basic component, or to notify the end users so they could cause' the problem to be evaluated, or to notify the Commission. Specifically, six out of 12 Conax squib valve explosive primer chamber (EPC).assem-blies were fcund to have epoxy (potting) voids and gaps around'the cir-cumference of the explosive primer devices. The power output of the EPC is an inverse function of any voids or gaps around the explosive primer device (86-01-01).

...or other entity subject to the regulations in this part shall adopt appropriate procedures to: (1) Provide for: (i) evaluating deviations or (ii) informing the licensee or purchaser of the deviation in order that the licensee or purchaser may cause the deviation to be evaluated...."

Contrary to the above, procedures had not been developed or adopted to provide for the evaluation or reporting of defects pursuant to 10 CFR Part 21 at the Conax Florida Facility (86-01-02).

This is a Severity Level IV violation (Supplement VII).
