Indiana and Michican Electric Company (DCCookNuclearPowerPlant)

Subject:

PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that 6 Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) will be issued on or about March 12, 1987 to Indiana and Michiaan Electric Company. This action involves the licensee's operations staff renderina both Unit 2 independent emercency core coolina system (ECCS) subsystems not operable while Unit 2 was operatina in Mode 1, in violation of the Technical Specification Limiting Condition for Operations. The north safety injection pump was not operable in that it had been isolated and de-eneraized, and the south safety injection pump was not operable in that two of its four injection flow paths had been isolated. This condition existed for approximately twenty hours and was identified several days later durina a records review by the NRC Resident Inspection Staff.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Reaional Administrator has been authorized ay the Director, Office of Inspection and Enforcement, to sian this action. The schedule of issuance and notification is:

Mailing of Notice March 12, 1987 Telephone Notification of Licensee March 12, 1987 A news release has been prepared and will be issued after the licensee receives the Notice. The State of Michiaan will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Followina NRC evaluation of the response, the civil penalty may be remitted, mitiaated, or imposed by Order.
