March 9, 1987 EN 87-17 0FFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Duke Power Company (0conee Nuclear Station, Units 1, 2, 3)

PROPOSED IMPOSITION OF CIVIL PENALTY - $25,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Twenty-Five Thousand Dollars

($25,000) will be issued on or about March 12, 1987 to Duke Power Company.

This action is based on the failure to provide adequate design control to assure that the emeraency feedwater pumps would remain operable under design basis transients. This failure in desian control resulted in the condition in which the emeroency feedwater pumps were susceptible to pump runout and inadequate net positive suction head under some anticipated design conditions in which the flow control valves remain fully open. The runout conditions could cause damaae to the pumps and a potential loss of emeroency feedwater function.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Reaional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The i schedule of issuance and notification is:

Mailing of Notice March 12, 1987 Telephone Notification of Licensee March 12, 1987 A news release has been prepared and will be issued after the licensee receives the Notice. The State of South Carolina will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitiaated, or imposed by Order.
