O APPENDIX A Unistrut Corporation Docket No. 99900362/86-01

. NOTICE OF VIOLATION As a result of the inspection conducted on June 2-6, 1986, and in accordance

.with Section 206 of the Energy Reorganization Act of 1976 and its implementing regulation 10 CFR Part 21, the following violations were identified and cate-gorized in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C), 49 FR 8583 (March 8, 1984):

A. Section 21.6 of 10 CFR Part 21, states, in part: "Each. . . corpora ti on. . .

subject to the regulations in this part, shall post current copies of the following documents in a conspicuous position...(1) the regulations in this part, (2) section 206 of the Energy Reorganization Act of 1974, and (3) procedures adopted pursuant to the regulations in this part...."

Contrary to the above, at the time of the inspection the Unistrut Corpor-ation did not post 10 CFR Part 21, Section 206 or their Part 21 procedures.

This is a Severity Level V violation (Supplement VII).

B. Section 21.21 of 10 CFR Part 21, states, in part, "Each... corporation,...

subject to the regulation in this part shall adopt appropriate procedures to: ...(2) Assure that...a responsible officer is informed if...a basic component supplied...(ii) Contains a defect...A director or responsible officer...shall notify the Commission. . .(2) Ini tial notification. . .shall l be made within two days following receipt of the information.... If i initial notification is by means other than written communication, a written report shall be submitted to the appropriate office within 5 1 days after the information is obtained." l Contrary to the above, the Unistrut part 21 procedure " Processing of Reportable Events" oid not specify or identify a time limit for notifica-tion or a method of notification of a defect to the Commission. ,

(86-01-02) l This is a Severity Level V violation. (SupplementVII) I C. Section 21.31 of 10 CFR Part 21, states, in part, "Each,. .. corporation.... l subject to the regulations...shall assure that each procurement docum nt for a facility, or a basic component issued by. . .i t. . . specifies. . .that the provisions of 10 CFR Part 21 apply." l Contrary to the above, Unistrut failed to impose 10 CFR Part 21 on purchase orders to their vendors of calibration services, material i suppliers, (mechanical properties and chemical certification) and l suppliers of heat treating services.
