APPENDIX A ITT Henze Docket No. 99901060/86-01 NOTICE OF VIOLATION As a result of the inspection conducted on June 23-27, 1986, and in accordance with Section 206 of the Energy Reorganization Act of 1974 and its implementing regulations 10 CFR Part 21, the following violations were identified and cate-gorized in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C), 49 FR 8583 (March 8, 1984):

A. 'Section 21.21 of 10 CFR Part 21 states, in part, "Each... corporation...

subject to the regulations in this part shall adopt appropriate proce-dures to: (1) provide for: (i) evaluating deviations or (ii) informing the licensee or purchaser of the deviation in order that the Licensee or purchaser may cause the deviation to be evaluated unless the'devia-tion has been corrected; (2) Assure that a director or responsible officer is informed. . . ."

Contrary to the above, at the time of the inspection ITT Henze did not have a procedure pursuant to 10 CFR Part 21. (86-01-01)

B. Section 21.31 of 10 CFR Part 21, states, in part, "Each... corporation...

subject to the regulations in this part shall assure that each procure-ment document for a facility, or a basic component issued by...it on or after January 6, 1978 specifies, when applicable, that.. 10 CFR Part 21 apply.

Contrary to the above, ITT Henze failed to impose the requirements of 10 CFR Part 21 on applicable subtier vendors for all purchase orders reviewed.
