PROPOSED IMPO5ITION OF CIVIL PENALTY - $50,000 This is to inform the Commission'that a Notice of Violation and Proposed
. Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000)-
will be issued on or about March 6,1987 to Duke Power Company for its McGuire Nuclear Station. This action is based on four violations of NRC requirements.
The first violation involves the failure to establish and maintain the opera-bility of the. nuclear service water system. The second involves the perfor-mance of an inadequate 10 CFR 50.59 evaluation used to justify cross-connectino the nuclear service water system, a configuration not specifically allowed by the Technical Specifications. The third and fourth violations address inade-quate test performance and evaluation and failure to establish and implement ddequate procedures associated With the nuclear service water system.

It should be"noted that the licensee has not been specifically informed of the enforcement action. The Reaional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:
Mailing of Notice.
March 6, 1987 Telephone Notification of Licensee March 6, 1987 A news release has been prepared and will be issued after the licensee receives the Notice. The State of North Carolina will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Followino NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
