OC3 February 12, 1987 EN 85-84A 0FFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Toledo Edison Company (Davis Besse)

IMPOSITION OF CIVIL PENALTIES - $450,000 By EN 85-84 dated December 13, 1985, the Comission was notified of the intent of IE to issue a Notice of Viol,ation and Proposed Imposition of Civil Penalties in the amount of $900,000 to Toledo ~ Edison Company. This action was based on two violations which resulted in the failure of the auxiliary feedwater system on June 9,1985 to perform its intended function as a result of improper torque bypass settings for certain safety-related motor-operated valves; six additional violations involving failures in the licensee's maintenance, testina, training, analysis and corrective action programs which led to the June 9, 1985 failure; and two violations involving generic problems related to maintenance and troubleshooting of pipe supports.
The licensee responded to the Notice in a letter dated January 27, 1986. After consultation with the Comission, mitgation of civil penalties in the amount of 50% was approved because of the licensee's significant proaress in its effort to identify and correct probleh's. Accordinaly, an Order Imposing Civil Penalty in the amount of Four Hundred Fifty Thousand Dollars ($450,000) has teen issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalties or request a hearing.
