Subject:

PROPOSED IMPOSITION OF CIVIL PENALTY - $12,500 g This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Twelve Thousand Five Hundred Dollars ($12,500) will be issued on or about March 26, 1987 to Cintichem, Inc.

This action is based on numerous violations of NRC requirements including the accumulated radiation exposure of 21.453 rem to the left hand of a maintenance worker who was handling equipment contaminated with radioactive material. The majority of the accumulated exposure was received by the worker while he per- 'q formed maintenance on mechanical manipulator hands removed from the hot cells for repair. This individual was allowed to perform maintenance on manipulator hands after an abnormally high exposure without (1) an adequate evaluation having first been performed to determine the cause of the abnormally high exposure and (2) the establishment and implementation of appropriate corrective measures to prevent recurrence. These actions demonstrate a lack of attention to and control of the radiation safety program. This lack of attention and control is \

further evidenced by the other violations identified during the inspection, t including the failure to provide workers adequate instruction regarding (1) occupational exposure limits, (2) performance of surveys, and (3) use of survey results. These deficiencies demonstrate the need for enhanced management involvement in the radiation safety program to assure adherence to NRC require-ments and the safe performance of licensed activities.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:

Mailing of Notice March 26, 1987 Telephone Notification of Licensee March 26, 1987 A news release has been prepared and will be issued after the licensee receives the Notice. The State of New York will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
