NOTICE OF VIOLATION As a result of the inspection conducted on January 27-31, 1986, and in accor-dance with Section 206 of the Energy Reorganization Act of 1974 and its imple-menting regulation 10 CFR Part 21, the following violations were identified and categorized in accordance with the NRC Enforcement Policy (10 CFR Part 21, Appendix C), 49 FR 8583 (March 8, 1984):

Section 21.31 of 10 CFR Part 21 states:

"Each individual, corporation, partnership, or other entity subject to the regulations in this part shall assure that each procurement document for a facility, or a basic component issued by him, hcr or it on c.r'after January 6, 1978 specifies, when applicable, that the provisions of 10 CFR Part 21 apply."

Contrary to the above, Airco failed to specify Part 21 as an applicable requirement on the following purchase orders (P0) (85-01-01):

1.

All P0s issued to vendors of calibration services for Jo Blocks, welding meters, impact testing machine, moisture furnace, analytical balances, micrometers, weighing scales, oven temperature controllers, temperature indicator for impact testing, tensile testing elongation gage, tensile machine, and the environmental chamber.

2.

Twenty-nine P0s issued under a blanket P0 #497802, dated August 15, 1985, to the Tensile Testing Co. for machining and stress relieving services. The P0sspecified fabrication of 3/4-10 tensile bolts, impact specimens and stress relieving of both the tensile bolt and impact specimens.

This is a Severity Level V violation (Supplement VII).
