IMPOSITION OF CIVIL PENALTY - $50,000 1
By EN 86-?9 dated May 1,1986 the Commission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of One Hundred Thousand Dollars ($100,000) to Commonwealth Edison Company. This action was based on several violations of NRC requirements.
Section I of the Notice involved the use of suryeillance procedures at its i
Byron Station that contained incorrect valve alionments for the residual heat i
removal (RHR) system which resulted in neither train of the RHR system beina able to inject into the four legs of the reactor coolant system.Section II of the Notice involved other violations related to surveillance testina, application of action statements, and post-maintenance inspections.

l The licensee responded to the Notice in a letter dated July 3,1986, which submitted payment of $50,000 for the violations in Section II of the Notice and disaareed with the violation in Section I of the Notice. After careful l
consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in Section I of in the Notice of Violation and Proposed Imposition o# Civil Penalty.

has been issued today.
Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearina.
