PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Connission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) will be issued on or about February 9,1987 to Philadelphia Electric Company.
This action is based on an 01 investigation that determined that a contractor health physics (HP) technician's employment was terminated by the licensee's field HP supervisor for enoaging in protected activity. The technician was pursuino radiological concerns that he might have received an overexposure while working in the Unit 3 offgas tunnel in March 1985. The termination constitutes a violation of the NRC employee protection provisions set forth in 10 CFR 50.7.
It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sion this action. The schedule of issuance and notification is:
Mailing of Notice February 9, 1987 Telephone Notification of Licensee February 9, 1987 A news release has been prepared and will be issued after the licensee receives the Notice. The State of Pennsylvania will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Followino NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
