ORDER SUSPENDING POWER OPERATION AND ORDER TO SHOW CAUSE (EFFECTIVE IMMEDIATELY)

This is to inform the Commission that an Order Suspending Power Operation l and Order to Show Cause (Effective Immediately) is being issued today to Philadelphia Electric Company for its Peach Bottom facility (Units 2 and 3).

The Order is based on the fact that at times during various shifts one or more of the Peach Bottom operations control room staff (including licensed

. operators, senior licensed operators, and shift supervisors) have for at least the past five months periodically slept or have been otherwise inattentive to licensed duties. In addition, plant management either knew or condoned this inattentiveness, or should have known of these facts, and either took no action or inadequate action to correct this situation. Prior NRC inspections have identified other instances of inattention to duty or failure to adhere to procedures on the part of licensed operators in the control room dt Peach Bottom.

Under the terms of the Order, the licensee may show cause within 20 days of

( the issuance of this Order why this Order should not have been issued by l filing a written answer under oath or affirmation and may also request a hea ring .

A news release has been issued and the states of Pennsylvania and Maryland have been notified.

ENFORCEMENT CONFERENCE On June 21, 1985, an enforcement conference was conducted with you, your employer (Philadelphia Electric Company) and members of the NRC Region I and Office of Inspection and Enforcement Headquarters staff to discuss the events which occurred on June 10, 1985 at the Peach Bottom Atomic Power Station. On that day, an NRC inspector observed you in the Unit 3 control room with your eyes apparently closed, thereby giving the appearance of being inattentive to your duties as a licensed reactor operator.

During the enforcement conference you maintained that, notwithstanding your appearance, you were not asleep and not inattentive to your duties, but were only relaxing your eyes. However, you indicated that you were aware that an NRC inspector was in the control room, and that your appearance had given the NRC inspector the impression that you were asleep, yet you did not change your demeanor. Further, you acknowledged that you exercised poor judgment by maintaining that demeanor until confronted by your shift supervisor, after he was advised of your condition by the NRC inspector. These actions and your failure to explain yourself to the inspector or supervisor at the time of this incident demonstrated an apparent lack of appreciation for the role of the NRC in overseeing licensed activities.

At the enforcement conference, you apologized for your actions of June 10, 1985
