As was previously discussed between Mr. C. E. Norelius of this office and Mr. C. Giesler of your staff, NRC Region III is providing all its licensees with copies of your presentation to us at the January 7, 1985, Enforcement Conference.

I was prompted to take this action in order to demonstrate, by specific example, an application of some aspects of the NRC Enforcement Policy, including those which provide for mitigation of potential escalated enforcement. This case exemplifies several pertinent provisions.

I am enclosing a copy of the letter which transmitted this information to all other NRC Region III utilities.

The March 8, 1984 revision to the NRC Enforcement Policy introduced a means of recognizing good licensee performance by providing for full mitigation of a civil penalty based on prior good performance in the general area of concern.

One of the cases where thir ortion was exercised by NRC involved the Kewaunee Nuclear Plant. I thought it uould be informative to provide you with a copy of that NRC enforcement package so you could review our application of this aspect of the enforcement policy.

Secondly, I was particularly impressed with the quality of the presentation by Wisconsin Public Service management during the Enforcement Conference with regard to this issue. The presentation reflected an indepth analysis of the event, an assessment of safety significance and a clear description of corrective actions which were very useful for me and my staff in reviewing this case. With the approval of Wisconsin Public Service Company, I am also enclosing a copy of that presentation for your information.

I would hope that the provision in the Enforcenent Policy to mitigate certain I civil penalties based on good performance would be an incentive to strive for excellence of performance at your facilities.
