This station is located on State Highway Route 9, l

i in Forked River, Lacey 'fownship, County of Ocean, State of New

draws substantral quantities of water from Forked River and j

On January 28, 1972, the "0yster Crcok Euclear Geno-rating. Station" experienced a shutdown'of operations.

The pla'nt did not operate in a normal manner until February 1,

-1972.

9.1 The shutdown was unscheduled and caused by an inad-vertent, negligent or willful act of the defendant's employees, agents or servants.

10.

The defendant continued to operato its by-pass or dilution pumps located above the plant during the period when the plant was shut dotm.

The operation of these pumps accelera-tod the cooling of the waters below the plant.

11.

As a result of the shutdown of the, plant and the continued operation of the aforementioned pumps, the tempera-

I ture of the waters belou the plant dropped drastically and i

rapidly causing thermal slioch and death to substantial quan-I titics of fish in said waters, on January 28, 29, 30 and 31, i
