Dear Sir:

1 Fubject: Oyster Creek Generating Station Docket No. 50-219  :

Technical Specification Change Request 264 Change of Ownership of Property within the Exlusion Area GPU Inc. announced plans to sell a number of properties. One property is part of the Oyster Creek site, including part of the exclusion area. GPU Nuclear submitted the proposed change to the Oyster Creek Technical Specification by letter to the NRC dated November 10, 1998. The proposed change will allow GPU Nuclear to modify that portion of the Technical Specification which precludes the sale ~of any property within 1,358 feet of the center of the Reactor. It is - - not apparent what regulatory requirements are l

involved with the release of this property. Therefore, in order for the State of~New Jersey to effectively review this proposed change, we need the following additional information:

1. -Please provide the NRC regulatory requirements which apply to the area designated as the " site" and the area

! designated as the " exclusion area." We are particularly [

interested to learn more with regards to the NRC's

2. Please provide the NRC's position on whether this sale of a large portion of the site, which includes part of the exclusion area will be handled as a partial license l termination under NRC regulations.
